Welcome to Fruits n Foods. Fruits n Foods provides access to the Fruits n Foods website features and other products and services to you when you visit or shop at Fruits n Foods, use Fruits n Foods products or services, use Fruits n Foods applications for mobile, or use software provided by Fruits n Foods in connection with any of the foregoing (collectively, ” Fruits n Foods. Services”). Fruits n Foods provides the Fruits n Foods Services subject to the following conditions.
By using Fruits n Foods website, you, a registered or guest user in terms of the eligibility criteria set out herein (“User”) agree to these conditions. 2. ELIGIBILITY
a) Use of the Website is available only to such persons who can legally contract under the Contract Act, 1872.
b) If you are a minor i.e. under the age of 18 years, you shall not register as a user of Fruits n Foods. com and shall not transact on or use the Website.
c) By accepting the Terms or using or transacting on the Website, the User irrevocably declares and undertakes that he/she is of legal age i.e. 18 years or older and capable of entering into a binding contract and such usage shall be deemed to form a contract between the Website and such User to the extent permissible under applicable laws.
d) The usage of the Services offered through the Website is only available if the address of the User to which the product(s) is/are to be delivered is within Dhaka City, Bangladesh. It is possible to receive Fruits n Foods service and products to other major cities in Bangladesh through courier service. For any courier service delivery Fruits n Foods shall not be liable for any product damage or missing.
3. ELECTRONIC COMMUNICATION
When you use site Fruits n Foods, or any of our services or contact us via phone or email, you consent to receive communication from us. You authorise us to communicate with you by e-mail, SMS, phone call or by posting notices on the website or by any other mode of communication. For contractual purposes, you consent to receive communications (including transactional, promotional and/or commercial messages), from us with respect to your use of the website and/or your order placed on the Website. Additionally, any disclosures posted on the site, or sent to you by email fulfill the legal obligation of communication made in writing.

All content included in or made available through Fruits n Foods, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, website is the property of Fruits n Foods or its content suppliers and protected by Bangladesh and international copyright laws. We offer a wide range of Fruits n Foods Services, and sometimes additional terms may apply.
5. TRADEMARKS
In addition, graphics, logos, page headers, button icons, scripts, and service names included in or made available through any Fruits n Foods Service are trademarks or trade dress of Fruits n Foods in Bangladesh and other countries.
6. REVIEWS, COMMENTS, COMMUNICATIONS, AND OTHER CONTENT
You may post reviews, comments, photos, videos, and other content; as long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights (including publicity rights).
Fruits n Foods has the right but not the obligation to monitor and edit or remove any activity or content. Fruits n Foods takes no responsibility and assumes no liability for any content posted by you or any third party.
7. PRODUCT DESCRIPTIONS
Fruits n Foods attempts to be as accurate as possible. However, Fruits n Foods does not warrant that product descriptions or other content of Fruits n Foods product is accurate, complete, reliable, current, or error-free. If a product offered by Fruits n Foods itself is not as described, your sole remedy is to return it in unused condition.
8. PRICING
“List Price” or the suggested price displayed for products on Fruits n Foods represents the full retail price listed on the product itself , suggested by the of a product itself, on as provided by manufacturer or supplier or estimated in accordance with standard industry practice; or the estimated retail value for a comparably featured item offered elsewhere. The list price or suggested price is a comparative price estimate and may or may not represent the prevailing price in every area on any particular day. We regularly check List Prices against prices recently found on Fruits n Foods and other retailers. Certain products may have a “Was Price” displayed, which is determined using recent price history of the product on Fruits n Foods. Delivery costs will be charged in addition; such additional charges are clearly displayed where applicable and included in the ‘Total Cost’.
Despite our best efforts, a small number of the items in our catalog may be mispriced. If the MRP of an item sold by Fruits n Foods is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of such cancellation. And if the stated price on the product is lower than Fruits n Foods, we will, either refund the amount or replace the product according to your preference, when acknowledged.
9. RETURN POLICY
We have very simple and fast return and replacement policy. Please call our complain department within 24 hours from the delivered time. As soon as we hear from you we will arrange for return or replacement.
A user may return any product during the time of delivery, or within 7 days if:
1. Product does not meet user’s expectation.
2. Found damaged during delivery
3. Have doubt about the product quality and quantity
4. Received in an unhealthy/ unexpected condition
5. Is not satisfied with the packaging
6. Finds product unusable
But following products may not be eligible for return or replacement:
1. Damages due to misuse of product
2. Incidental damage due to malfunctioning of product
3. Any consumable item which has been used / original seal broken / tampered
4. Products with tampered or missing serial / UPC numbers
5. Any damage/defect which are not covered under the manufacturer’s warranty
6. Any product that is returned without all original packaging and accessories, including the box, manufacturer’s packaging if any, and all other items originally included with the product/s delivered.
10. REFUND POLICY
Fruits n Foods tries its best to serve the users but if under any circumstances, we fail to fulfill our commitment or to provide the service, we will notify you within 48 hours via phone/ text/ email. If the service, that Fruits n Foods fails to complete, requires any refund, it be done maximum within 07 Days after our acknowledgement.
Refund requests will be processed under mentioned situation:
1. Unable to serve with any product.
2. Customer returns any product from a paid order.
3. Customer cancels a paid order before it has been dispatched.
Fruits n Foods will transfer the refund amount to the user’s original payment source Debit or Credit card / bKash / Mobile recharge within 07 days. Fruits n Foods will not promote cash refund.
11. SUPPLY POLICY
Fruits n Foods is responsible for manufacturing and packing some of its consumable and external use products, Fruits n Foods also use suppliers product therefore, Fruits n Foods tries to control the quality, but do not give quality assurance for any except Fruits n Foods own brand products.
If any user, at the time of receiving the order delivery, finds any product injurious to health/ life/ security, we will take full liability and will accept return of that product. If the user faces any threat after 12 hours of the provided delivery, we will consider it as a lacking within the quality assurance from the manufacturers or suppliers.
All products displayed on the website are subject to change and are subject to availability.
12. MODIFICATIONS
Fruits n Foods reserves the right to modify these Terms and Conditions. Such modifications shall be effective immediately upon posting on Fruits n Foods. You are responsible for the reviewing of such modifications. Your continued access or use of Fruits n Foods shall be deemed your acceptance of the modified terms and conditions
